Three Motives for Divorce in the Digital Era in the Perspective of Islamic Family Law

Abstract

The digital era is a very extraordinary era, an era where the development of the times is increasing and advancing, life is getting easier with all digital. However, this progress has challenges in the life of a family, where a family cannot form a harmonious family, So that this disharmony leads to divorce. Divorce is divided into 2 (two) types, namely lawsuit divorce and talaq divorce. Talak divorce is a divorce filed by the husband to a wife, and a lawsuit divorce is a divorce filed by a wife against her husband and decided by a Judge in Court. The result of this study is that there are 3 (three) major motives in divorce, namely: Economic Motives, Domestic Violence, and Infidelity. These motives are generated from the results of interviews from divorced parties in Sumbawa Regency. The specific cause of these three major motives is the first, in the motive of divorce which is motivated by the economic motive, namely dissatisfaction with the maintenance provided by the husband. Then in the second motive, domestic violence is caused by jealousy from the husband's side. Third, the motive for infidelity is caused by incompatibility and the presence of a third person. This research is a type of qualitative research, a data collection technique using interview techniques. The discussion on this matter will be reviewed from the perspective of Islamic Family Law both from the Qur'an, Hadith, and the Compilation of Islamic Law.
